Livvie B.V. (“Livvie”) respects your privacy and this Privacy Policy describes how Livvie collects, uses, discloses and protects your information when you use the services and mobile application provided or operated by Livvie, including any functionalities and content, as well as any other related services, media or website (collectively, the “Service”), including subsequent updates of the Service. Please read this Privacy Policy carefully before you start using the Service. If you do not agree with the terms of this Privacy Policy, please do not start or continue using the Service.

Livvie reserves the right to modify this Privacy Policy at its sole discretion, at any time and without notice. You acknowledge that it is your responsibility to review this Privacy Policy and familiarise yourself with any modifications, and we advise to review this Privacy Policy periodically. Your continued use of the Services constitutes acknowledgement of such modifications and agreement to abide by the modified Privacy Policy.

COLLECTION OF YOUR INFORMATION

We may collect information about you in multiple ways. The information we may collect through the Service includes:

Personal information

Personal information is information through which you can be personally identified. Personal information Livvie collects may include your name, date of birth, gender, country of residence, email address, telephone number, credit card, other payment information, or any other information that you provide when using the Service.  As you continue to use the Service, you will regularly provide Livvie with personal data such as your dietary behaviours. We collect information you choose to provide us voluntarily, including through registration, when using the Service, when contacting Livvie or other inquiries. You are not obligated to provide us with personal information of any kind. Please be aware that if you choose not to provide us with certain information, this may impact the Service provided to you.

General information

General information or Log Data is information we collect automatically when you use the Service and does not identify you personally. General information may include but is not limited to your operating system, device name, device type, device identifier, device location, Internet Protocol address, internet browser, domain, host, the date and time you access the Service, the pages you visit, the number of visits to the Service and specific pages and/or specific parts of the Service you use.

Cookies and other tracking technologies

The Service may use Cookies or other tracking technologies to help improve your user experience. Cookies are files with pieces of information which the Software stores on your device and can later retrieve. Cookies and other tracking technologies may be used for purposes such as: automatically updating the Software; remember your information to avoid re-entering upon your next session using the Service; provide customised advertisements or information; monitor and store usage metrics. You may choose to accept or refuse such Cookies, but please be aware that if you refuse to allow Cookies, this may impact the Service provided to you. You can also delete Cookies which have been previously stored.

Information from Third Parties

The Service may by default or upon request collect information from Third Party services such as social networks. Such information may include personally identifiable information such as your name email address, gender, date of birth, place of residence, profile picture, contacts and other information you choose to make public. You may choose to accept or refuse access of the Service to certain Third Party information.

USE OF YOUR INFORMATION

Collection of your information helps Livvie to provide you with the Service and a customised and smooth user experience. Purposes for which Livvie may use the information collected through the Service include but are not limited to the following:

  • Providing the Service to you, including creating and managing your account and processing payments.
  • Optimise and customise the Service according to your usage of the Service based on profiling.
  • Responding to inquiries, processing transactions and providing support or requested information.
  • Contacting you about your account, service updates, promotions, surveys, newsletters and other activities related to the Service per email, unless you opted out of such communications.
  • Aggregate anonymous statistical data for analysis and use by Livvie or Third Parties.
  • Assist law enforcement and prevent illegal activities.
  • Customised marketing such as through advertisements.

Please note that marketing sent by Livvie to you is based on a customer relationship as a legal ground for processing personal data.  The use of personal information for marketing will be based on a legitimate interest and to provide you a personalised experience based on relevant offers. If under relevant personal data regulation consent is required, you hereby give Livvie consent to use your information as described above and in accordance with this Privacy Policy.

DISCLOSURE AND TRANSFER OF INFORMATION

Personal information collected from you may be shared with Affiliates and Third Party “Data Processors” that process data on behalf of Livvie, such as providers for hosting, data storage, data analytics, payment processing, customer service, marketing and advertisements. If you invite contacts to the Service or provide information on associated public media of the Service, your personal information and posted content may be visible for other visitors in perpetuity. If required to respond to legal process or investigate potential violations of our policies, or to support law enforcement authorities in investigating suspected criminal activities, we may disclose your information as permitted or required by law. In case of bankruptcy, acquisition or other reorganisation of Livvie, your information may be transferred to the successor entity.

THIRD PARTY SERVICES

The Service may provide links to Third Party services, including advertisements and external services, that are not affiliated with Livvie. Upon using these links to leave the Service, any information you provide to these Third Parties is not covered by this Privacy Policy, and we cannot guarantee the privacy and security of your information. We recommend that you inform yourself of the privacy policy and terms and conditions of any Third Party service before visiting or providing your information. Livvie is not responsible for the content or privacy practices and policies of any Third Party.

Additionally, we may rely on Third Party service providers, which may use cookies, web beacons or other tracking technologies to collect user information. This may include your behaviours related to the Service for services such as customised advertising. Livvie does not control and is not responsible for these Third Party tracking technologies.

The Service uses Google Analytics for Firebase, which is an analytics service provided by Google. Firebase Analytics may share your information with other tools provided by Firebase such as authentication, remote configuration, notifications or crash reporting. To run Google Analytics for Firebase, the Service uses identifiers, usage information and tracking technologies. You may opt-out of certain Firebase features through your device settings, such as the device advertising settings or through the Software settings.

SECURITY OF YOUR INFORMATION

Livvie strives to protect your personal information with commercially acceptable and reasonable means, but please be aware that despite our efforts, no security measures, storage or data transmission is 100%  perfect or impenetrable. There is always a risk of unauthorised access to your data and Livvie can therefore not guarantee absolute security of your personal information.

CHILDREN POLICY

We do not knowingly market or provide the Service to children under the age of 13 years, nor solicit information from children under the age of 13 years. If you are aware of any personal information that may be collected through the Service from children under the age of 13 years, please contact Livvie to initiate appropriate action.

OPTIONS REGARDING YOUR INFORMATION

You may at any time review or change your account information or delete your account and personal information through the Software settings or by contacting Livvie at hello@livvie.co. Please be aware that deleting your account will result in Livvie deleting all your personal data from the databases to the extent permitted and required by law, including behaviour information you provided regularly. In case you do not want to receive marketing communications from Livvie, such as email, you may opt-out of these communications at any time.

CALIFORNIA PRIVACY RIGHTS

If you are a resident of California, the California Consumer Privacy Act and “Shine The Light” law permits you to once per year request information about categories of personal information we disclosed to third parties for direct marketing purposes and the name and address of these third parties. Under certain circumstances you may also opt-out of the sharing of certain categories of personal with third parties for their direct marketing purposes. If you are under the age of 18 years and a resident of California, you have the right to request removal of publicly posted information through the Service. If you are a resident of California and want to make any above requests, please contact Livvie.

GOVERNING LAW

This Privacy Policy is governed by and construed in accordance with the laws of the Netherlands, without regard for its conflict of law principles. Any dispute or claim arising out of, or related to these Privacy Policy, shall be resolved by the public courts of the Netherlands.
